HMB SALT Group's Fred Marcus participated in the Bloomberg BNA State Tax Advisory Roundtable on Friday, January 27, 2012. As a member of the State Tax Advisory Board, Fred was joined by leading state tax experts to discuss the most important recent developments and trends in state taxation. Topics covered by the group included:
- recent actions by the U.S. Supreme Court regarding state tax cases,
- significant nexus rulings recently issued at the federal level,
- the latest round of "click-through" nexus or "Amazon" laws enacted by the states,
- the prospects for a federal solution to the online sales tax debate,
- the uncertainty and planning opportunities arising from the income tax sourcing issues surrounding electronic commerce,
- recent gains made by the states in taxing pass-through entity owners, including those with limited ownership interests,
- two non-tax related cases decided by the U.S. Supreme Court last year that could make it more difficult for states to satisfy Due Process requirements when seeking to tax nonresident pass-through entity owners,
- "cloud computing" and the states' shift to market-based sourcing regimes,
- a challenge to the Tennessee Department of Revenue's attempt to "borrow" a Multistate Tax Commission tax attorney for a tax case,
- a class-action lawsuit against a contingent-fee auditing firm, and
- the constitutionality of federal Pub. L. No. 86-272.
